craft reply to 1.5. Embassy (delayed for pp.)

The Board of Trade are not prepared to

accept the contentions advanced in our letter of

the 3rd of October (No.12). Apart from denying

the validity of the analogies advanced in that

letter they repeat their previous argument that

the restriction amounts to a prohibition of

importation and, therefore, is in conflict with

the policy of H.M.G. towards the convention for the

abolition of export and import prohibitions and

restrictions. This convention, however, is not applicable to any Colonies etc. which do not adhere

accede to it separately, and H.K. has now decided

not to adhere (see despatch No.430 of 10th Septr.

duplicate herewith). So far as H.K. is concerned,

therefore, the convention may be ignored.

The Board also quote the precedent of

the restrictions imposed on tin dredging machinery

in the F.M.S. (see 52325 and previous papers).
